'As the peyrnent is a joint function of both aciisod it must be that the accused used thig money for their own ends: Accordingly I fi±i4. bth acOsad guilty of stoaling Shs.542/90 which 00-oT5erativo Money. ' With ret I am anable to agx'oO to this rdasoning and conclusion. On the contrary all the evidence on record prove conclusively that payment was not the function of a committee member i.e. 2nd appellant, In my view prosecution failed prove any case at all against the 2nd appellant and his conviction is wrong. For these reasons I allow this appeal of the 2nd. appellant, Conviction for 2nd appellant is, hGraby çuashed and sentence is set aside. It is ordered that 2nd appellant i.e. Mahewa Kilangila be sot free forthwith unless otherwise legally held. As for 1st appellant in my opinion prosecution proved the case against him beyond all reasonable doubts and the learned trial magistrate was quite correct in convicting him, Now I will deal with the 3rd ground of appeal which is that there is no evidence that the money alleged to have been stolen belonged to Ilamata Cotton Growers Society. Mr. Ragarabamu has an interesting point here. He said once Zengo signed 'Control Shoet t t and was issued with a receipt, the money though not handodover to him is still the proerty of Zengo and not the Society. Learned State Attorney could not agree to this submission. I too am unable toEgreo to this submission, Money till it is handedover to Zengo was still the property of the Society and Zongo had merely a right to claim it from the Society and the society owed that money to Zengo as at that time. Only when it was paid to Zengo, it became his proarty. I think this deals with the third ground of appeal. As the fourth ground appeal Mr. Rugarabamu submitted that there was no evidence that the Ilamata Cotton Grower's &ciety was a society registered uxider the Co—operative Societies Ordinance. Learned State Attorney replied that Ilamata Cotton Grower's Society is a branch of Nyanza Co—operatie Society and judicial notice must be taken to the effect that society was registered, PW.l - who is the 2nd general ol,erk in his evidence said Ilarnata Cttn Grower's Society is a branch of Nyanza Co—operative Union whose registration number is 818. But he did not remember registration number of Ilamata Cotton Grower's Society. In my view this is enough to establish that llama-ta Cotton Grower's Society is a society registered under the Co—operative Societies 'dina nc c As for the last ground of appeal which is that conviction was against the weight of evidence and sentence was excessive. I have already dealt with conviction -part of it. Its for sentence it is the minimum and not at all excesjo.t. For these reasons this appeal of the 1st appellant fails and is dismissed in its entirety (. B. Fatal). 29th Ma±ch,. 1973.
