APPLICATION FOR LEAVE TO APPEAL

matter was heard in open court and after hearing both parties,
judgment was reserved. The reserved judgment will be uploaded

I have read the heads of arguments filed by the parties onto
CaseLines and heard the arguments of the representatives of the
parties in open court when the application for leave to appeal was
heard on 4 December 2024.

In terms of section 17(1) of the Superior Court Act, Act 10 of
2013, leave to appeal should only be granted where a Judge
is of the
view that the appeal would have a reasonable prospect of success, or
when there is some other compelling reason why the
leave to appeal
should be given.
[3]
After hearing the arguments and perusing the heads of arguments, I am
of the view that there is no reasonable prospect of success
for the
appeal and that another court will arrive at a different decision.
[4]
There are also in my view no compelling circumstances why the appeal
should be heard by another court. There is no important
point of law
to warrant consideration by a higher court.
[5]
I have nothing more to add to the initial judgment handed down.
ORDER:
The
application for leave to appeal is dismissed with costs, costs to
include cost of senior counsel and the scale to be on Scale
C.
