The respondents and the interested party are not opposed to the withdrawal save that they insist on being awarded costs. 2.Under Section 27 of the [Civil Procedure Act](/akn/ke/act/1924/3), costs follow the event. There are no proper grounds to warrant a departure from the above general principle. Consequently, the ex-parte applicant shall bear costs of the suit. 3.The result is that this suit is marked “withdrawn”. The ex-parte applicant shall bear costs of the suit.
