Accused
Ruling
1.I have considered the evidence adduced by the Prosecution. There is evidence that there was a confrontation with the deceased that culminated in a fight.
2.The Pathologist’s report confirms that the deceased died as a result of severe head injury secondary to sharp force trauma following assault.
3.Without delving into the evidence in depth, I hold that the prosecution has established a prima facie case.
4.The Accused is placed on his defence.
