Republic v Korir (Criminal Case E172 of 2026) [2026] KEMC 4 (KLR) (27 January 2026) (Sentence) Neutral citation: [2026] KEMC 4 (KLR) Republic of Kenya In the Nakuru Law Courts Criminal Case E172 of 2026 PA Ndege, SPM January 27, 2026 Between Republic Prosecution and Victor Korir Accused Sentence 1.The accused person herein, Victor Korir, has been convicted upon own plea of guilty of the offences of Cutting and Removing Forest Produce from a Public Forest without Authority contrary to Section 64 (1) (a) as read with Section 68 (1) of the [Forest Conservation and Management Act](/akn/ke/act/2016/34) of 2016; and Being in Possession of Logging Equipment in a Public Forest without Authority contrary to Section 64(1)(k) as read with Section 64(2) of the same Act in the 2 counts herein. 2.He has admitted that on 22/01/2026 at around 4.00pm at Logoman public forest in Njoro sub-County within Nakuru County, he was unlawfully found cutting 19 pieces of bamboo tree, a forest produce, in the said forest with a total destruction caused estimated at Kshs. 8,000/-, the property of Kenya Forest Service without a license or permit from the Chief Conservatoire of forests. 3.He also admitted in the second charge that on the same day and at the same place and time, he was unlawfully found in possession of logging equipment, a maasai sword, in the same public forest without authority or permit from the Chief Conservatoire of forest. He is a first-time offender as no records were furnished against him. I do therefore sentence him to a fine of Kshs. 24,000/- in default to serve 5 months imprisonment in each of the counts herein.14 days Right of Appeal explained **DATED, SIGNED AND DELIVERED AT NAKURU IN OPEN COURT 27th.
