1.The accused person herein, John Kariuki Mureithi, has been convicted upon own plea of the offence of Failing to Renew Driving License contrary to section 30(4) as read with (7) of the [Traffic Act](/akn/ke/act/1953/39), Cap. 403 Laws of Kenya. He admitted that on 03/02/2025 at around 12.30pm, along Njoro -Nakuru road in Nakuru County, being a driver of a motor vehicle registration number KDN 180F make Mazda Demio, he drove the said motor vehicle along the said road and failed to renew driving license which expired on 30/09/2024.
2.He is a first-time offender as no previous record was furnished by the prosecution. He has pleaded for forgiveness. I have looked at the charges herein and the relevant provisions, section 30(4) and (7) of the [Traffic Act](/akn/ke/act/1953/39), which provide as follows: -4.Driving licenses shall be issued, and upon expiry renewed on production, by a licensing officer upon payment of the prescribed fee, and a driving license so issued or renewed may be expressed to be valid for a period or of three years from the day of issue or renewal.7.Any person who contravenes or fails to comply with this section shall be guilty of an offence and liable –(a)on first conviction to fine not exceeding twenty thousand shillings or to imprisonment for a term not exceeding three months; and(b)on each subsequent conviction to a fine not exceeding thirty thousand shillings or to imprisonment for a term not exceeding six months or to both such fine and imprisonment.
3.Given that the accused herein is a first-time offender who has pleaded guilty hence saved the court’s time in receiving, recording and evaluating the evidence in a full trial, I do hereby fine the accused Kshs. 3,500/-, in default to serve 14 days imprisonment.14 days right of appeal explained.
