I I J ' 3.2 The gist of the Respondents' arguments was firstly, that . I the amended petition and reliefs sought by the Petitioner I do not raise constitutional questions fit for this Court's I determinat.ion because they are general questions of law. I Secondly, that the questions raised are baired by the t principle of res judicata. The Respondents therefore urged I us to dismiss the Petitioner's action: in its entirety. I t 3.3 Our attention was drawn to Order 14A Rule t1(2) of the White Book to emphasize that this Court is clothed with the jurisdiction to dismiss a cause or·matter or hiake such order o, judgment as it thinks just. \ I 3.4 On the Petitioner's first. claim in the amended petition, it the Luhgu was argued that question of who the Chief t should be or is, and whether the Tafuna C~ieftaincy follows a patrilineal or matrilinea1 system of succession is I not a constitutional question, issue or matter. 'That the High Court has in fact already l tried the question under its criminal jurisdiction and ' found Raphael Chipampe Tafuna Sikazwe, the person on I whose behalf the Petitioner commenced his action guilty of the charge of murder and accordingly sentJnced him. l That the said Raphael Chipampe Tafuna Sikazwe appealed l - the conviction and sentence of the trial court to the Court - - -- - - l - of Appeal. ' raise Constitutional questions fit for this Court's determina.tion. The Respondents particularly submitted that the question of who the Lungu Chief should be or is; and whether the Tafuna Chieftaincy follows a patrilineal or matrilineal system is not constitutional iri nature. Similarly, t~at the question on restitution of evidence on whether Raphael Chipampe Sikazwe Tafuna terminated the life of the late Benson .Mukupa Kaoma also does not present ~onstitutional issues for determination by this Court. On, the other hand, the Petitioner has maintained that his claims are constitutional and well within the R19 __ j_ --- ·-. ' whether civil or criminal" 5. 7 The jurisdiction of this Court was again spelt out in a recent decision of this Court in the case of the LAW ASSOCIATION OF ZAMBIA AND CHAPTER ONE FOUNDATION LTD v ATTORNEY GENERAL4 in which we stated tha.t·the jurisdiction of this Court though extensive, is still limited by the Constitution itself in Article 128 which is subject to Article 28. 5.8 With thrs in mind, the question that arises is whether or not the reliefs sought by the Petitioner in his amended petition are constitutional in nature and properly before this Court.
