Code 4 Conseuentlr, he was sentenced to jail for a term of five(5) years Being aggr.ovod by that decision 9 he has now appealed to this court against both.convictiofl and sentence. The facts of the case not his dispute, as established in evidence may be briefr stated as follows. On the night of the 9th /10th April 1998 the shop of the oolainant, namely PW.1 ATEU'L4Ni AKIDL KAIZA, where is at Majengo area s within the Municipality of 11 Tang. was burgled thereupon, an assortment of Cigai'rettes and one calcu.ltor at valued at shse733,700/=. The incident was reported to the Police who. set the wheels of investigation in motion s It has been. deposed by P2 OMàRi MUNGHtJMtJ a taxi - driver that on April 10, 1998 on or about 8 ptm the appellant 'who was in the company of two other persans hi.i'ed his taxi from the Iviabanda ya Papa taxi' - stand It is in his deposition that the two loaded into his cab two big bQxes 'which according, to his recollection were mi'kod.
