PLAiNTIFF VERSUS, ROSE ATUPELE NGOGO ............ 1ST DEFENDANT BLANDINA KYANDO ................ 2ND DEFENDANT Counsel: Mr. Mdamu for the Plaintiff (Defendant present in person) JUDGMENT BWANA, J. The defendants have admitted liability and committed themselves to start repaying the loan with effect from 1 November, 2000 on each work day, the sum of shs.30,000/- up to 31 January 2001. The defendants have also committed themselves to pay a lump sum of shs. 10 million between now and 31 January 2001. Any remaining sum will be paid as directed by this court. Counsel for the plaintiff has agreed to forego the interest that would otherwise be charged on the principal sum. In terms of Order XII R4 of the CPC, judgment on admission is entered in favour of the plaintiff. The defendants —jointly and/or severally- are to pay back the loan under the following terms - f/$•, 64 ..

With effect from 1 November, 2000 up to 31 January 2001, the defendants shall deposit with the plaintiff, the sum of shs.30,000I- each work day as part payment of the said loan. Meanwhile between 1 November, 2000 and 31 January 2001, the defendants shall make another deposit of shs.10 million as part payment of the said loan. Thereafter, the defendants shall settle the remaining sum on a weekly basis in equal instalments until the debt is liquidated, the figure to be worked out between the parties. However this arrangement should be completed by 31 March 2001. The defendants are to pay for costs of this suit. No interest on the principal sum shall jie charged. Sgd: Dr.y/1.
