It is on the basis of the foregoing that, I· am respectfully not in agi.e- ement with Mr. Makange 1 s novel point that availabil:.Lty of letter of of:f'.er is not evidence of registration, In the resuJ.t 1 I hereby dismiss the first ground of complaint;;, I now turn to the second gcound of complaii;i.t as raised by Mr. Ma.kange on behalf of the Applicant. In the instant case it is irrlisputable that there was a visit to a. locus in quo.. But, as is e:g;i.dent from the record of the trial Court and the jud@nent in particular, the trial magistrate's findings and conclusion were not based on what he gathered from the locus in gu2_ but on evidence adduced in court •. It is on the bass of the foregoing that, I am respectfully in· agl'eement with Mr. -Sang 1 ka that visiting the locus in quo did not pre.- ju.dice the trial and hence the rule in NIZAR 1 s case (supra) is not applicable to this case.- In the final event, I a'TI far from being persuaded that there are sufficient grounds that warrant this court to give leave to appeal to the Court of Appeal as prayed.
