RESPONDENT The respondent prosecuted the appellant before the primary court of Ileinbo of the Offence of Forcible entry 1 contrary to section 85 of the Penal Code. The appellant was. convicted - as' charged and sentenced, to six months ' imprisonment. Thapellant felt aggrieved and preferred an appeal to the district court of Mbeya. The district court, however, did not hear and decide the appeal on merits. The district court nullified the proceedings and judgment of the primary court -' 'n the sole ground that the judgment was signed by the magistrate alone, and not by his two azs.essors."a ' well., and"thus offended the mandatory; piovision.o-f:- S aub.-rule (2) of rule 3 of the Magistrate& Courts (Primary Courts) (Judgment of Court) Rules, G.N.No. 2 of 1988.'
