a n a p p e a l a g a i n s t a refusal, of s u c h l e a v e . I n e a c h c a s e , h e s a y s , t h e p u r p o s e is to p r e s e r v e t h e s t a t u s q u o in o r d e r t o e n s u r e t h a t if t h e a p p l i c a t i o n f o r t h e o r d e r s is g r a n t e d , o r if t h e a p p e a l s u c c e e d s , t h e a p p l i c a n t o r t h e a p p e l l a n t , as t h e c a s e m a y be, d o e s n o t o b t a i n a m e r e b a r r e n s u c c e s s . It s h o u l d b e r e a l i s e d t h a t a l l t h e c a s e s c i t e d b y P r o f e s s o r S h i v j i w e r e c i v i l p r o c e e d i n g s . It s e e m s to m e t h a t t h e r e is n o j u d i c i a l p r o n o u n c e m e n t o n t h e p o i n t r a i s e d b y t h e A t t o r n e y G e n e r a l in T a n z a n i a a n d t h a t , t h e r e f o r e , t h e p r e s e n t c a s e is o n e o f f i r s t i m p r e s s i o n . I h a v e g i v e n t h e m a t t e r s u f f i c i e n t c o n s i d e r a t i o n a n d I h a v e p r e f e r r e d t o g o w i t h w h a t t h e S C P (1993) s a y s , n a m e l y , t h a t if a j u d g e at f i r s t i n s t a n c e h a s r e f u s e d l e a v e t o m o v e t o j u d i c i a l r e v i e w , h e is f u n c t u s o f f i c i o a n d h a s n o j u r i s d i c t i o n t o g r a n t a n y f o r m of i n t e r i m r e l i e f . I h a v e t a k e n t h e v i e w t h a t w h e n a j u d g e in t h e H i g h C o u r t r e f u s e s l e a v e t o a p p l y f o r p r e r o g a t i v e o r d e r s , h e t h e r e b y t h r o w s the m a t t e r out of the C o u r t . It is t r u e t h a t t h e m a t t e r c a n be t a k e n t o t h e C o u r t of ' B u t w h e r e a n a p p l i c a n t g o e s t o t h e C o u r t o f A p p e a l , h e is, a s t h e S C P ( 1 9 9 3 ) s a y s , r e n e w i n g th e a p p l i c a t i o n f o r l e a v e t o m o v e for j u d i c i a l r e v i e w , a n d I n e e d n o t j [^ ^ -j — ad d t h a t C o u r t is v e s t e d w i t h j u r i s d i c t i o n t o d e a l w i t h t h e m a t t e r . In the event, I have to sustain the Attorney General's objection a n d strike out the chamber summons. It is so ordered. I have to confess that it has not been easy to come to that decision in complete certitude. Indeed, more often than not,
