This pnt was argued during trial,. The t1:'iaJ_ court upheld the point and dismissed the suit basing its decision on a passage in Tito Korrielio Versus Gregory E.: Mshana and Bi •. Bertha A. Hassan ( 1981 1,H.T·· 128).,, That passage 1·eads:.
