-3- documents in respect of En1oyrnent Civil Cause No 6199 between Deeciatus K. Marc' vs Tanzania posts Corporation were ever presented to the Civil Registry at this court for processing to the District Registrar for admission and finally for registration of the intended appeal, Mr. Odria averred that instead of appeal documentsin respect of the said parties being presented tc' the Registry frr filling as averred by Mr Mutaitina, there were presented appeal ocuments in respect of Justus Kaina Bwire vs, Tanzania Pc'sts Corporation also arising from Musnina RM Court Emplryment Civil Cause No,, 9/1996 which had earlier been presented for filing by the Tanzania Legal Cc'rporation in 1997, and the appeal hadalrady been registered as H/C Civil Appeal No. 32/97 So., in substance Mr. C.dira's•contention is that the Tanzania Legal Corporation inadvertently presented to the Civil Registry appeal documents in the same matter twice, that is in respect of Musoma PM Enloyment Civil Cause No, 9/1996, but did not at all present to the Civil Registry the appeal documents in respect of Musoma PM Enloyment Civil Cause N°. 6/96 in respect of Deodatus K. Maro vs, The Tanzania posts Corporation which is the subject matter of this application s As I have already stated, Mr. Odira had to enter the witness box and testified on oath s and was crc'sseantUed by Mr, Mutaitiria on the matters which Mr. Mutaitina alleged Mr. Odira has perjured. In the course of his testimony, Mr. Odira produced to this court the Civil Movement File for Civil Cases from the Civil Registry section at this oc'urt which was in use in 1997, in which the appeal documents in respect of Musoma PM's Court Emplc'yment Civil Cause No, 9/1996 between Tanzania posts Corporation V. Justus Magma Bwire were proessed for admission to the District Registrvide Minute No, 209 A (iii) on 2 3/7/97 and in which the District Registrar adniitted the said appeal docume.its vide his Minute No. 210(i)A(i).—(iv)on28/7/97, that is just five days liter. The appeal in respect of that Enloyment.. Civil Cause was registered as HC Civil Appeal No, 32/97after flipg fee$ / a

Register, and were satisfied that tha.t entry was correct. Again Mr, Oaira pr'ducL t' the Cn- the Civil Cases M'vement Register from the Civil Registry sectir'n that was in use in the year 1998, in which other similar appeal documents Were prr'cesseri for adnnssi"n by the Djrict Registrar. Thse dncun'ents were again in respect rf Musrma R1's ;'ourt Enloyment Civil Cause. No, 9/96 beteenTanzania.Posts Corporation i .Vs. Justus Kagina Bwire, I observed that entry, and also the c -'unsel for' the parties observed that .ntry andfound it to be correct s that is such as Odira had stated. Mr. tdira fu' the' testified, that, upon discoering that similar appeal.-docuents had been "presentec1 by Tanzania Legal Corporation in respect of an apeal that had already been filed and registeied as H/C Civll'Apeal No. 32/97, he contacted Mr. Rugairnukarnu the Registry Clerk with the Tanzania Legal COrporatieI Mranz.a Branch, and inf-'rmed him aout the anomaly or coni us -'n 1 and asi ed him t- cone an cUect this sec(nnd batch of appeal d"cunen3 which Mr. Pugainukamu did, and thereafter every thing on the matter went quiet until-much later in the m-nt .h of'ebruary, 1999 when Mr. R)1gaiimikaaa wrote a chit (CW1) to Mr. Cdira, to inquire about appeal documents in respect of Musoma PM's Court Empinymcntt. Mr e'ther the same had been prc'.cesEed and admitted by the District Registr'ar A't that material time W (cUra was on leave,' sr no reply was give 'ri to Mr 4 Rugaimukamu' 5 inquiry, That was on 8/2/99. Again rn 10/2/9 Mr, Mutaitina wrote the conlaint lt.ter District Registrar to inquire about the d'eiay,..in processing arid registering the a.ppeal in resect of Mus.oma PM' S Court Employment Civil Cause No. 6/96 between Tanzania Posts Corporation vs eodatus K. Maro.

-6- Although Mr. Pugaimukamu the Registry Clerk with the Tanzania Legal Corporation Mwanza branch also came and testified to this court and made a strained attempt to supiort Mr. Muta.itinat a versions yet the pesitin remains the same, that is there is no tangible evidenãe either direct or circumstatiàl which pxeves on any balance' of probabilities that Tanzania Legal Corporation ever presented to this..Cit appeal document.s in respect of Musoma RN's Court Employment Civil: Cause Io 6/96 between Tanzw1ia posts Corporation VS, Dedatus hire carefiily 1iteried and considered the arguments of both learned counsel for thQ.parties in this application. A160 I have carefully reviewed the evidence 1by affidavits and that whicn was adciced vira voce cy Mr. Odira and by Mr. Rugaimukamu during the hearing of this applicat±on lam of the considered vèw and 1 find that the Tanzania Legal Corporation confused and presented twice to this Court at the Civil Registry appej documents in respect of the sane matter, that is in Musrma . Mts C"urt Employrlent Civil Cause No. 9/96 between Tanzania posts Cr' ora rtion vs. Justu Kagina Bwire 4 I also find that these documents wre.:reurned to Tanzania Legal Corixration, and that Tanzania Legal Corpôaton. w'e...uly informed by the Civil Registry, that a similar appeal had already ben filed, The Tanzania Legal Corporation then ket quiet withot'cting diligently to confirm that in fact the appeal between Tanzania posts Corporation vs 'Deodatus K, Maro had;'I been filed. They did nt make efforts to discover the confusion and. tO:.. rectify the situation s To me this is an exhibition of negligence which cannot be countenanced by courts of law n This is especially.. so when the.., negligence comes from a renoied Firm of Advocates in this Country the ....
