On thes e plo t s e r e c t e d are the Tbaa dh M o s q u e and the s h o p p r e m i s e s o c c u p i e d by the App e l l a n t s . S t a r t i n g from 1987, Ahmed Al-lomki, E x e c u t o r of the Es t a t e of the late M o h a m e d S u l e i m a n N a s s o r I.emki a u t h o r i s e d the R e s p o n d e n t s (The R e g i s t e r e d trust e e s of the Tbaad h M o s q u e ) to c o l l e c t ren t from A p p e l l a n t s i n c l u d i n g p r e s e r v a t i o n and m a i n t e n a n c e of the premises, and indeed since then till 1993 w h e n the c o n f l i c t e r r u p t e d the A p p e l l a n t s paid thei r ren tals to Res p o n d e n t s . Tn or about 1993 the R e s p o n d e n t s felt need of e x p a n d i n g th e i r m o s q u e for wha t they called "a surg e in m e m b e r s of w o r s h i p p e r s " . The e x p a n s i o n e n t a i l e d c o n s t r u c t i o n s w h i c h wo uld affect p r e m i s e s o c c u p i e d by the Appella nts . T h e y (R espondents) p r o c e e d e d and issue d a two months' n o t i c e to the A p p e l l a n t s to vacate. As w o u l d be e x p e c t e d the a p p e l l a n t s did not move. The R e s p o n d e n t s then i n structed Mr. Kwikima , Adv ocat e, who filed an a p p l i c a t i o n a l r e a d y r e f e r r e d to. C h a l l e n g i n g Mr. M a f t a b ' s p r a y e r to ame n d the a p p l i c a t i o n in w h i c h he a r g u e d t hat the T r i b u n a l is l e g a l l y e m p o w e r e d to g i v e that lea ve u n d e r R u l e 8 of the R e g i o n a l H o u s i n g T r i b u n a l Regulations., and that in a n y c a s e the a m e n d m e n t w o u l d not c r e a t i n j u s t i c e to a n y p a r t y , the A p p e l l a n t s j o i n e d h a n d s and p r e l i m i n a r i l y , v e r y s t r o n g l y o b j e c t e d to the sa id p r a y e r a d v a n c i n g a r g u m e n t s ( o r a l l v and by c o u n t e r a f f i d a v i t s ) e n c o m p a s s i n g o b s e r v a t i o n s a l r e a d y m a d e in t h e i r d e f e n c e s and w h i c h i n c l u d e d that ( 1 ) the A p p l i c a n t s ( R e s p o n d e n t s ) had no c a u s e of a c t i o n as t h e y w e r e not the l a n d l o r d but r a t h e r s i m p l y c h a r g e d w i t h c o l l e c t i o n of r e n t s and that, as the first a p p l i c a t i o n d i s c l o s e d no c a u s e of a c t i o n it is a n u l l i t y and thus a n u l l i t y c a n n o t be am ended, ( c i t i n a A u t o G a r a g e T,td versus'^Mot.okov (N o .3) 1971 R.A 514). (ii) t hat t h e y s h o u l d h a v e b e e n g i v e n the s t a t u t o r y n o t i c e of six m o n t h s as p r e s c r i b e d u n d e r s. 25 (1) of the R e n t R e s t r i c t i o n Act. ( n i ) t h a t the 1st and 2nd ( A p p e l l a n t s ) s h o u l d h a v e b e e n g i v e n a l t e r n a t i v e r e a s o n a b l e or s u i t a b l e a c c o m o d a t i o n u p o n the l a n d l o r d p r o v i n g th at he w a n t e d the p r e m i s e s for his o w n use and not business. (iv) that f a i l u r e to i n d i c a t e that. 3rd and 4t.h ( A p p e l l a n t s ) are limi t e d l i a b i l i t y C o m p a n i e s result in n o n - e x i s t e n t p a r t i e s b e i n g sued. (v) th at in a b s e n c e of tena n t A 1a n d l o r d r e l a t i o n s h i p the t r i b u n a l w o u l d h a v e no j u r i s d i c t i o n on suc h ma tter. (vii) that the p r o p o s e d a m e n d m e n t does not giv e the pa rt ic u l a r s . (viii) the p r o p o s e d amendment, is not made in good fa ith as the orig in al a p p l i c a t i o n was base d on a n o n - e x i s t i n g t it 1 e . (ix) that the r e q u i s i t e fees w e r e not paid. T s h o u l d pos e here and m ake one i m p o r t a n t o b s e r v a t i o n : in 1994, that is aft e r the filing of the a p p l i c a t i o n the R e g i s t e r e d T r u s t e e s of Tbaadh M o s q u e m a n a g e d to s e c u r e o w n e r s h i p of the d i s p u t e d premise s. Tn a bri e f r u l i n g the Regional H o u s i n g T r i b u n a l d e c i d e d in favour of the R e s p o n d e n t s by s i m p l y h o l d i n g that as the p r o p o s e d a m e n d m e n t s hav e not yet. bee n filed the y cou l d not be ch allenged. T he tribunal o b s e r v e d and c o n c l u d e d "ho w will the T r i b u n a l k n o w if the i n t e n d e d a m e n d m e n t will not hav e cau s e of a c t i o n w i t h o u t s e e i n g it. first? The a m e n d e d a p p l i c a t i o n has to be see n first ......... if there is any a t t a c k it can be raised. Tt. is by w a y of g r a n t i n g leave to ame nd the a p p l i c a t i o n ....... w h e n we can k n o w the c o n t e n t s of the said a m ended applica t i o n " . I " R e i n g a g g r i e v e d and d i s s a t i s f i e d w i t h the order and rulin g m ade on 6t.h October.. 1 994 by The Regional H o u s i n g Tribunal of Dar es S a l a a m (sitti ng at Dar es Salaam), the a p p e l l a n t s h e r e b y appeal aga ins t the same on the fol lowing, amo ngs t other, g r o u n d s :-
- Th e R e g i o n a l H o u s i n g Tribunal of Dar es S a laam (h e r e i n a f t e r c a lled "the T r i b u n a l " sho uld have d i s m i s s e d the a p p l i c a t i o n s for amendment, b e c a u s e :- (a) On the date the main a p p l i c a t i o n was filed 1993 in the T r i b u n a l by the R e s p o n d e n t abo v e - n a m e d , the R e s p o n d e n t w a s not the landlord of the p r e m i s e s o c c u p i e d by the a b o v e - n a m e d appellan ts. H ence the R e s p o n d e n t had no c a u s e of acti o n a g a i n s t any of the a p p e l l a n t s and the Trib una l shoul d have eit her d i s m i s s e d the a p p l i c a t i o n or r e j e c t e d the a p p l i c a t i o n w i t h o u t p r o c e e d i n g to hear the R e s p o n d e n t ' s a p p l i c a t i o n to am end the main appl icat.i on . (b) T h e r e wa s not sufficient'' e v i d e n c e b e f o r e the Tribunal that the R e s p o n d e n t was the owne r of the w h o l e b u i l d i n g in w h i c h the suit p r e m i s e s w e r e situated. H e n c e the Tribun al sh ould have d i s m i s s e d the R e s p o n d e n t ' s a p p l i c a t i o n to amen d the applic ati on. (c) The Tribunal sh ould have d i s m i s s e d the a p p l i c a t i o n b e c a u s e :- (i) on the d a y the main a p p l i c a t i o n was filed by the R e sponded, there did not ex ist b e t w e e n the p a r t i e s the r e l a t i o n of Land l o r d and tenant; (ii) the m a i n a p p l i c a t i o n and c h a m b e r a p p l i c a t i o n wa s filed by the R e s p o n d e n t a g a i n s t non e x i s t i n g R e s p o n d e n t s (now appe l l a n t s ) and hence both the a p p l i c a t i o n s w e r e a n u l l i t y and could not be a m e n d e d .
- The tribunal shou l d ha ve held that b e c a u s e the main a p p l i c a t i o n filed by the R e s p o n d e n t wa s a nullity, it c o uld not be amended.
- The tribunal shou l d have r e j e c t e d the a p p l i c a t i o n of The R e g i s t e r e d T r u s t e e s of Tbaadh b e c a u s e p r e s c r i b e d court fees w e r e not paid w h e n the main (first) aool icat.ion was filed. ' ' “ 7

The a p p l i c a t i o n for a mendment should have b een d i s m i s s e d b e c a u s e : (a) The p r o p o s e d a m e n d m e n t s w h o l l y d i s p l a c e d the original a p p l i c a t ion; (h) The p r o p o s e d a m e n d m e n t s int r o d u c e d d i f f e r e n t cause of action; (c) The c l a i m of the Respondent,, whe n the main a p p l i c a t i o n was filed, w a s based on a title w h i c h n e v e r exsisted. (d) W h e n the a p p l i c a n t s filed the O r i g i n a l \ M a i n ap p l i c a t i o n , the a p p l i c a n t s w e r e onl y the agent of the landlord and an agent had no cause a g a i n s t any of the appe llants. (e) The mai n a p p l i c a t i o n did not d i s c l o s e any c a u s e of a c t i o n ag ain st the first and secon d appellants. (f) As far as the 3rd and 4th a p p e l l a n t s are c o n c e r n e d the a l l e g e d landl ord had not giv e n the s t a t u t o r y n o t i c e as r e q u i r e d by s e c t i o n 25(1) (e) of the Rent R e s t r i c t i o n Act... 1984. H e n c e the a p p l i c a t i o n of the R e s p o n d e n t for p o s s e s s i o n as p r e m a t u r e a n d \ o r bad in law". The H o u s i n g A p p e a l s T r i b u n a l als o d i s m i s s e d the A p p e llants' pleas. A f t e r q u o t i n g R e g u l a t i o n 8 of the Regi ona l H o u s i n g T r i b u n a l s R e g u l a t i o n s , 1990, it held (again for c l a r i t y let me q u o t e the relev a n t par t of that dec isi on) . " ...... the RHT was cor rect in g r a n t i n g the app l i c a t i o n . The rest of the m a t t e r s that have bee n r aised in the Appeal such as: -
- W h e t h e r at the tim e the a p p l i c a t i o n w as filed in December.. 1993.. the a p p l i c a n t was a landlord. 2.W h e t h e r the a m e n d m e n t w as that of a nullify.
- W h e t h e r th e r e e x i s t e d a c a u s e of ac t i o n be f o r e April 1 994.
- That, th e r e had not. bee n paid g o v e r n m e n t r e v e n u e for the f i l i n g of the applica t i o n . 8
fS. T h a t an a g e n t w h o is c h a r g e d w i t h a d u t y of r u n n i n g and m a i n t a i n i n g a p r e m i s e s c a n n o t s u e on b e h a l f of a l a n d l o r d e t c w e r e m a t t e r s w h i c h h a d to a w a i t t h e trial b e c a u s e t h e r e h a d to b e a d d u c e d e v i d e n c e to p r o v e or d i s p r o v e t h o s e m a t t e r s . Most of th ose m a t t e r s r e f e r r e d to us in this appeal., to uch on the m a i n a p p l i c a t i o n and the y cannot be s a t i s f a c t o r i l y d e a l t w i t h at a s t a g e of p r e l i m i n a r i e s . For e x a m p l e w h e r e a s Mr. K e s a r i a and Mr. R a i t h a t h a , w i s h at this sta ge that the Tribu n a l b e l i e v e that,at the time of fi l i n g the a p p l i c a t i o n in D e c e m b e r 1993, the a p p l i c a n t as a p e r s o n c h a r g e d wit h the r u n n i n g and m a i n t a i n i n g of the mos que , he was a mere agent, w h o was in law, i n c o m p e t e n t to mak e the a p p l i c a t i o n b e c a u s e he had no title, Mr. M a f t a h on behalf of the applicant.\responde.nt., ar g u e s that, th eir clients' title was r e g i s t e r e d ever si n c e 8.1 .1993. Thi s ther e f o r e , r e q u i r e s to be h e a r d and d e t e r m i n e d by w a y of e v i d e n c e and not. by m ere p r e l i m i n a r y ob je ction. Tn the in stant case, b e f o r e us, we see no re a s o n w h y we s h o u l d i n t e r f e r e w i t h w h a f * t h e RHT d e c i d e d to a l l o w amendment, of the p l e a d i n g s sin c e it. has not bee n s h o w n to us by the a p p e l l a n t , tha t the RHT " p r o c e e d e d u p on w r o ng m a t e r i a l s o r u p on a w r o n g p r i n c i ple" ( u n d e r l i n i n g is m i n e ) . On the o t h e r hand, the a p p e l l a n t s hav e not sh own that by the R HT f r e e l y a l l o w i n g the a m e n d m e n t s to the original a p p l i c a t i o n any i n j u s t i c e has bee n or is go i n g to be o c c a s s i o n e d . A l t e r n a t i v e l y , had the r e s p o n d e n t s X a p p e l 1 ants s e n s e d that the r e w o u l d have been o c c a s s i o n e d i n j u s t i c e by the RHT a l l o w i n g that th ose a m e n d m e n t s be done, by the a p p l i c a n t X r e s p o n d e n t , then , they ought, to have p r a y e d for costs. T h e y did not.
