IN THE HIGH COURT OF TAI'ZA1Ik AT FIBEYA, ' HIGH COURT CRIMINAL APPEAL NO0 1+8 OF 1998 ' ORIGINAL CRIMINAL CfSE NO, 523 OF 1998 OF THE DISTRICT COURT OF MBEYA AT !3EYA TU TI JACKSON 0669APPELLANT VERSUS • THE REPUBLIC '000 0000 00 6 0000 ? 0 00000 00 00 IRES?ONDENT JUDGWiENT Thti d/o Jackson is a slender pretty girl of 18 years schooling in Form IV at Sangu Secondary School, Mbeya Municipality who has already registered'to do her final Form IV examination this coming next month .' if October/November 1998 and her aunt and guardian has alrady paid her school fees and level examination fees0 But, just 3 months prioito her examination on about 5th July'1998 Tuti d/o Jackson faced a serious stumbling problem which would block her entire academic dreams and make her lose face to her aunt, family and the fellow school students, She got pregnant By the time the pregnancy as so weeks old (about 5 months) she could not withs,tad the problem and the shame any 'longer, She decided to solve the problem by herself by termiriatihg her pregnancy secretly by drinking nxious medicine and crudely pulling out the fcetus from' her w'mb 'by her own bare hands in orderto procure abortion which she succeeded with 01: ncrsocricncesn He gt great pains obviously and resked her lifc, she got arrested by the police and' charged in court for committing the of fcae of abortion c/ 157 of the Penal Code, and lastly she got convicted as charged on her 'own plea 'of guilty and sentenced tr 3 years impriscnment She 'n,w.has appealed conviction and sentence through her advocate the learned Mr. Mwakolo who has challenged the convictin as being wrongful due to the appellant's plea of guilt being uncqcal
He argued that what was thought to be a pregnancy of eu proved by a doctor and was actually merely a protrusoi ofher stomach which (. she had a right to remove d The learned advocate also argued that since the noxious medicine the appellant drank was not medically or chemically proved to have been poisonous or noxious and capable of inducing a miscarriage of a pregnancy the necessary ingredients of the offence of abortion c/s 157 of the P.C. had not been proved The learned Mr. Mwakoid (Advocate) also challenged part of the proceedings which were.in kiswiili as being illegal. The imprisonment term for 3 years which has shattered the academic dreams of doing her Form IV Examination. This October was also opposed ap being too were to be sustained, He also argued that the appellant was mentally unbalanced in occasions and could not have appreciated all of what she was doing so as to warrant a guilty mind worth of a conviction and such a beavy penalty of 3 years imprisonment0 The learned Mr. Nangela (SA) has opposed the appeal against the conviction since, he argced, the plea of guilty was uncqivical for the

The learned Mr. Nangela (SA) on the cther hand conceded that the alth2ugh the conviction was proper th4 sentence was toQ severe to be supported by the Peublic.
