Breaking into a dwelling hous with intent to steal c/s 294 (I) 6f the Fenal Co4e~ and £2_2J.- Stealing c/s 265 o·f the :J?enal ,Code in- that.-·having __ p:;rokim into and entered that dwelling house of one_ Mariani N'dosi on the I.II.88 at about 23.00 hours at Sinoni in Monduli' District, the accusod therein stole one radio cassette silver crown, one hami bag, seven under woars and oash Shs •. IOtO'jO/"" total valued at .:ihs I<)~-600/= the. property of the said Mariam Ndosi. The trial Court cohvictod both accused thereby sentencing them to four years imprisonment on Count I and to 9 months imprisonment on Count· 2; tho sc11tc11cos to &iln concurrently, Tho accused wore also ordered to pay dhs. II025/= compensation to. the complainant for tho stolen goods. Accused No. 2-,Loscrian Kiroia did not appeal. Accused No. I appealed over a year after tho judgement was passed. Mr. Lundu, learned State Attorney submitted that the appeal is hopelessly time barred so it should bo struck off, •••• /2 ..
