This is an appeal.fron Mbulu District Court Crinino.1 Case
No. 76 -of 1988 wherein ·one John Salcta.y was chnrgcd-with cattle theft

c/s 265 and 268 of the penal code. Tie was convicted and sentenced
to 5 yen.rs irnprisoru:1ent. He is now appealing against the conviction
and the sentenced.
.As point;:;d out by Mr. Kioomogoro learned State Attorney,
the CO'JY of judpnt ,-ras SUlJ;)lied to tle appellant on the 26/11/39

but he did not file his ai)peal til the 8/5/90, soae six nonths
later so the appeal is tir,ie barred and ou.&ht to be struclc off the

Section 25 of the Magistrates Court.s ,\ct No. 2 of 1984
provides for appeals foL1 District Courts to the High Court. The
said section 25 states:-

by the clecis:i.on or order, of a district court
in the exercise of its appellate or revisional
jurisdiction nay, within thirty days after the

The present appeal falls uncer section 25( 1) (a) quoted
above. Having obtained tbe copy of judgraent on-the 26/9/89,; the

before the 26/10/89. The appeal was delayed until the 8/5/90, six
months later so it is time barred unde~ section 25(1)(a) of the
Magistrates Courts Act No. 2 of 1984 •
