In the said.Criminal Case twelve aooused persons pleaded guilty to arson o/s 319 of the penal code in that they wilfully and unlawfully set the complainant's five houses valued at aha .• 1,O06,00O/= on fire. The trial court sentenced· each of the 12 accused persons to 3 years imprisonment subjec~ to confirmation by the High Court. When the file was forwarded to the High Court for confirmation of the sentence• Mwak.ibete J 0 ,on the 31.588 varied the sentence to signing a tbree years · shs. 50,000/= bond each to be of good behaviour pursuant to section 33 of the penal code •. Mwakibete, J. also ?rdered the accused to jointly and severally pay oompensation to the complaipant for the destroyed propel:'ty to be ass·essed by the triai court. On the 2s.7.aa the triai magistrate ordered the acused persons to pay abs. 100 9 000/~ coupensation each after ta.king into account the value. which . · of the destroyed propertuer the charge sheet is abs. 1,O86 1 O00/=I The order was mad'F in the presence of the accused and none of them appeaied. against the said order. That being the position, the second order of the 6.11.89 for shso 100r000/= coopensation or 6 months imprisonment in default was null and void owing to the existence of the prior order of the 28.7.80 which was and is still in existence pending execution • •••••••• /2
