JUDGMENT
IN APPLICATION FOR LEAVE TO APPEAL
H
F JACOBS AJ:
[1]
The two defendants apply for leave to appeal the
summary judgment for the return and delivery of the motor vehicle set
out in the
order of 15 May 2025. The defendants have not shown
any misdirection of fact or misdirection of law that would justify
the
granting of leave to appeal. Under the circumstances I am
not of the opinion that the appeal would have any reasonable prospect
of success or that there is some other compelling reason why the
appeal should be heard.
[2]
Under the circumstances I make the following
order:
1.
Leave to appeal is refused with costs, taxable on
a scale as between attorney and client.
