Introduction
[1]
The applicant, the
defendant in the trial, launched an application for leave to appeal
against the judgment and order handed down
on 22 April 2025.
[2]
The applicant raised
several grounds of appeal. These grounds involve the question of an
interpretation of the factual evidence
and an assessment of the
quality of the evidence. Since I handed down a written judgment that
contains the reasons for my findings,
I am not inclined to repeat the
same herein.
[3]
After considering the
grounds of appeal, the pleadings, and the evidence, I am not of the
opinion that the appeal would have a reasonable
prospect of success
or that some other compelling reason exists as to why the appeal
should be heard. In the result the application
for leave to appeal
stands to be dismissed with costs on Scale B.

In
the result, the following order is granted:
1.
The application for leave to appeal is
dismissed with costs on Scale B.
