Ruling
1.The elections carried out by the 1st Respondent Union, at its Branches appear to have generated multiple disputes.
2.The disputes have liberally been filed in different Courts in different Counties, by different players, even through they relate to the same subject matter.
3.The Petitioners herein make reference to Nairobi Petition E013 of 2026, and Kiambu Petition E025 of 2026, where the Courts are said to have issued orders which have been disregarded by the Respondents.
4.There is real danger in light of these multiple disputes, that inconsistent court orders are issued, or that candidates who have not been elected validly, and in defiance of court orders, assume office.It is ordered: -a.The application filed by the Petitioners dated 10th February 2026 is certified urgent.b.The Respondents are restrained from gazetting, swearing in, or allowing any persons elected at Nakuru KUPPET Branch elections on 7th February 2026, pending hearing and determination of the application.c.The 5th Respondent shall not register any person elected at the said elections, pending hearing and determination of the application.d.The Petition and the application shall be served upon the Respondents forthwith.e.The Respondents shall file and serve their responses within 14 days of service.f.The Petition is immediately transferred to the E&LRC Nairobi, to be mentioned and heard alongside Nairobi Petition E013 of 2026.
