BEFORE HER HONOUR NANA ADWOA SERWAA DUA-ADONTENG JUDGE SITTING AT AKROPONG CIRCUIT COURT ON THE 13th DAY OF NOVEMBER, 2024. SUITNO:AR/AKP/CC/ D10/03/2025 THEREPUBLIC VERSUS TETTEHTHERESAHOWUSUAAH FINALJUDGEMENT Accused Person(Unrepresented) --Present InspectorEvansAyimbisa representing Republic --Present Tetteh Theresah Owusuaah, Aged 23, student: for that you on the 16th day of October, 2024 at about 8:25pm at Tanoso in the Atwima Nwabiagya Municipality and within the jurisdiction ofthis court, without lawful authority, youuttered certain abusive words to wit: ‘That foolish and stupid things you have been coming to Eunice work place to do,’ to the annoyance of one Justina Addai Biney with intent to provoke breach of the peace orwhere the breachofthepeace is likely tobe occasioned. PLEA The court explained to the Accused what the pleas of Guilty, Not Guilty and Guilty withExplanation wereand the effect ofeachplea. Accused pleaded Guilty simpliciter. FACT Complainant Justina Addai Biney is unemployed and resides at Tanoso whilst the accused Tetteh Theresah Owusuaah is a student of AAMUSTED and resides at Abuakwa. The complainant’s son is married to the accused elders and there is separation in the marriage due to their marital issues. On 16-10-2024, at about 7:25pm, the accused withTelephone number 0539173875called her sister’shusband twice but he couldn’t answer. At about 8:30pm, she called the complainant with the same number, changed her voice and she hurled insults on the complainant to wit: that stupid and foolish things you have been coming to Eunice work place to do, be careful. Immediately after the statement, she hung the call and removed the sim from her phone. The complainant suspected her in-law the accused sister and she made a report at the Abuakwa DOVVSU. The complainant’s in-law was invited by police and she denied the offence and knowing the said number. The said telephone number was forwarded to the police intelligent unit where the details of the sim number, the details of the phone which was used to call and its location was revealed. Through that, the accused was arrested and, in her investigation, cautioned statement to police, she denied the offence but admitted having called the complainant with the said sim number. After investigation, she was charged with the offence and brought before this honorable court. CONVICTION ONOWN PLEA(COP) Hearing pleaded guilty simpliciter, theaccused personis convicted onher ownPlea. PRIOR CONVICTION PLEAOF MITIGATION SENTENCE Accused is sentenced to sign a bond of good behavior for 6 months and in default, to serveatime of2months.
