In 03/03/23, at Barekese in the Atwima Nwabiagya North District in the Ashanti Region and within the jurisdiction of this court, you appropriated two male goats valued GH1,000.00 the propertyofEbenezer Appiah. Peter Bonsu @ Network a driver. In 03/03/23, at Barekese in the Atwima Nwabiagya North District in the Ashanti Region and within the jurisdiction of this court, you dishonestly received a male goat valued GH 500.00 the property of Ebenezer Appiah which you knew to have been obtained or appropriated by means of crime to wit: stealing. PLEA The court explained to the Accused what the plea of Guilty, Not Guilty and Guilty with explanation were and the effect of each plea. Accused pleaded Guilty Simpliciter on count one. FACTS Complainant Ebenezer Appiah is a driver, and resides at Barekese whiles A1 Alfred Kusi Asare @ sokota aged 25 years is a driver’s mate and A2 peter Bonsu @ network aged 29 years is also a driver all resides at Barekese. In January 2023, complainant detected theft of his two male goats valued GH 1000.00 after the group returned from grazing. Complainant was informed by witness in this case of having spotting his white and brown male goat in A2 house and proceeded to the said house and found same in a cage. On03/03/23, A2was apprehended and in his caution, statement mentionA1as the person who sold the said goat to him at GH 200.00 leading to the arrest of A1. After investigationA1and A2were charged and put before this honorable court. CONVICTION ONOWN PLEA(COP) Having pleaded Guilty Simpliciter to the offence of stealing two male goats, accused personis convicted onhis ownpleaofthe offence. PRIOR CONVICTION Accused person is an ex-convict but we could not prove the records from Akropong District Courttofurnish tothe court. PLEAOF MITIGATION I admit stealing the goat but asI was in police custody, the complainant located the goat and I was releasedbecause I threatened tocourse the complainant.
