REASONS FOR JUDGEMENT
LE GRANGE AJ:

This Court dismissed an application for
leave to appeal
ex tempore
with
costs on 26 March 2024.

On 2 April 2024 a request was made for
reasons, which is provided herewith as follows:

After due consideration of the application
for condonation and considering that the application (and the facts
surrounding the application)
is not vehemently opposed, this Court
found it to be in the interest of justice to grant condonation.
Due to the applicant seeking an indulgence,
this Court made an order that costs be paid by it.

After due consideration of the application
for leave to appeal and the grounds and basis thereof this Court
found that there are
no new or novel points raised which was not
already raised in the application for recission.
[5]
This Court has extensively dealt with, and
provided reasons for, each and every point raised, in its judgement
that was delivered
on 15 June 2023 and persist therewith, as if
specifically dealt with herein.
[6]
Considering the above this Court is of the
view that an appeal would have no reasonable prospect of success on
these points, nor
are there compelling reasons why an appeal should
be heard.
[7]
Considering the fact that the scale of
costs has been agreed upon this Court granted costs accordingly.
[8]
In the result the following order was made:
1.
The application for condonation is granted,
the applicant to pay the costs thereof.
2.
The application for leave to appeal is
dismissed with costs on an attorney-and-client scale.
